About the role
Reporting into the GM Commercial you will be responsible for leading and managing commercial activities supporting the bids and tendering process for two sectors in our business which will include Urban Infrastructure and Government across the ANZ region.
Primary responsibilities and accountabilities will include:
- Undertake pre-contract commercial activities, including reviewing head contract and tender conditions, preparing MOUs, joint venture agreements and subcontract and supplier agreements.
- Lead tender negotiations and assist in contract awards.
- Assist in preparation of reliable cash flow forecasts.
- Identify contract specific risks and opportunities, including legal, commercial, operational, environmental, safety and others.
- Lead risk and opportunity review processes for complex contracts, identify associated costs and implement mitigation strategies
- Design innovative commercial models that optimise profit while providing value add/continuous improvement to clients.
- Ensure compliance with internal process and statutory requirements.
- Resolve disputes across a range of issues, achieving a positive commercial advantage.
- Apply processes for bonds, guarantees, warranties and insurances.
- Provide detailed commercial handover documents for awarded contracts.
- Use leadership skills to resolve contractual issues (interfacing with legal where required).
- Proactively respond to changes in client and stakeholder needs and expectations and develop relationships formed on trust.

The successful candidate will have the ability to build strong relationships and networks with key stakeholders whilst working collaboratively across a diverse and complex environment. You will be resilient, adaptable and someone who is comfortable making decisions and taking the initiative. Key to your success will be your ability to bring people together, build relationships and manage conflict in a diplomatic and professional manner.
Other key skills and attributes include:
- Relevant Degree in law, commerce, quantity surveying, construction management, engineering or a related discipline
- Comprehensive knowledge of pre-contract commercial activities including cash management
- Understands profit and loss statements and projected cash flow statements
- Ability to hold a leading role in pre-contract commercial activities
- Comprehensive knowledge of cost and budget information
- Ability to comprehend the profit drivers of different commercial and partnership models
- Ability to apply various techniques to seek constructive outcomes to disputes. Able to influence others and defend commercial positions
- Awareness of the relationship between head contracts and subcontracts. Understands guarantees, warranties, insurances and bonds
- Ability to develop, record and represent to the relevant parties, compelling arguments for commercial departures and submission of claims. Able to evaluate tender documents and estimates
